When AI Starts Acting on Its Own: A New Chapter in Compliance
Every so often, a technological shift arrives that feels less like an upgrade and more like a turning point. In wealth management and brokerage compliance, artificial intelligence is beginning to feel exactly that way. For years, firms have experimented with generative AI in relatively contained settings—summarizing documents, helping staff find policies faster, or organizing research. Helpful, yes. Transformational, maybe. Risky, not especially.
But something new is emerging.
Regulators are now turning their attention to what many are calling “agentic” AI—systems capable of planning, deciding, and acting across multiple tools and datasets with limited human direction. In a recent public note, FINRA’s chief regulatory operations leadership described how firms are beginning to test these AI agents in real operational environments and invited the industry into an open conversation about how the technology should be governed. The tone wasn’t alarmist, but it was unmistakably serious. When technology moves from pilot to production, the risk conversation changes.
What makes AI agents different isn’t just intelligence. It’s autonomy.
Some agents are being designed to converse naturally with employees or clients while pulling information from several internal systems at once. Others can write and test software code, troubleshoot infrastructure, or support development workflows with minimal oversight. On the surveillance side, firms are exploring agents that can review trading activity, analyze anti–money laundering alerts, detect fraud patterns, and escalate concerns faster than traditional monitoring tools ever could. In more experimental corners, agents are even being evaluated for orchestrating business workflows or influencing trading decisions.
All of this creates a fascinating tension. The efficiency gains are real, and the competitive pressure to innovate is undeniable. Yet autonomy introduces questions that traditional compliance frameworks were never built to answer. When a system takes multiple steps to reach a conclusion, can a firm fully explain the decision trail? If an agent acts beyond what a user intended, who is responsible? And when sensitive data flows through interconnected systems, how confidently can firms prevent misuse or exposure?
These are no longer theoretical questions. They are operational ones.
Even the familiar concerns surrounding generative AI—bias, hallucinations, and privacy—take on new weight when an autonomous agent is involved. A flawed summary is inconvenient. A flawed decision executed across systems could be consequential. Misaligned optimization goals or shallow domain understanding could quietly push outcomes away from investor protection rather than toward it. For advisory firms grounded in fiduciary responsibility, that possibility demands careful reflection.
Cybersecurity leaders are raising parallel concerns. As AI agents gain access to calendars, email, storage, and internal applications, the attack surface expands in unfamiliar ways. Some experts now warn that malicious prompts could become the next form of malware, capable of manipulating autonomous systems into exposing sensitive information or taking unintended actions. It is a striking reminder that innovation and vulnerability often arrive together.
And yet, the regulatory message is not to stop. It is to engage thoughtfully.
FINRA is positioning this moment as a collaborative dialogue with member firms rather than a top-down rulemaking exercise. Firms that already maintain strong governance around generative AI—clear supervisory boundaries, controlled permissions, detailed logging, and auditable decision trails—will likely find themselves better prepared as agentic systems evolve. Responsible experimentation, not avoidance, appears to be the path forward.
